A man who spent 10 years in prison for the 1984 abduction and death of 13-year-old Candace Derksen is suing the province and Winnipeg police for wrongful conviction and imprisonment.
In the lawsuit, Mark Edward Grant accuses police of conducting a negligent investigation and Manitoba Justice officials of malicious prosecution. The suit was filed on Wednesday, October 16. The 55-year-old Grant is suing for $8.5 million in damages.
Derksen went missing on her way home from school in November 1984. Her body was found frozen in an industrial storage shed not far from her home weeks later. Her feet and hands had been bound together.
rant was found guilty of second-degree murder in 2011 but appealed and was acquitted after a new trial in 2017.
A judge ruled the DNA evidence against him was unreliable and of no value.
Following Grant's acquittal, Candace's mother, Wilma, said the family hoped the Crown would not appeal the decision. "It's been 33 years and this just means it's over for us. The process is over. And in that, there's relief. Of course, there was a bit of disappointment that it didn't arrive at the conclusion that we have personally arrived at," Wilma said. "That's going to be a little hard to come to grips with."
A spokesperson for Manitoba Justice confirmed in early November 2017 that the Crown would not appeal.
